A powerboat operator has today been found guilty by Plymouth Magistrates’ Court for the unsafe use of a vessel, following actions which endangered passengers, the operator themselves, and other water users in the vicinity of moorings and a public slipway within Plymouth waters.
The prosecution was brought by the Devon & Cornwall Marine Unit of Devon & Cornwall Police, supported by evidence provided by Cattewater Harbour Commissioners using powers available under the Merchant Shipping (Watercraft) Order 2023. This is the first time this legislation has been used in Devon & Cornwall.
The case demonstrates the effectiveness of modern legislation in addressing dangerous behaviour on the water and promoting safer recreational boating practices.
The defendant was fined a total of £1,205, including associated court costs.
In addition, following collaboration between local authorities and enforcement partners, the individual has been issued with a Community Protection Notice Warning (CPNW), prohibiting them from using any waterways within Plymouth for a period of 12 months.
Cattewater Harbour Commissioners have welcomed the outcome.
“We are pleased with today’s result, which demonstrates the flexibility and effectiveness of both newly established national legislation as well as existing local Directions and Byelaws in maintaining safety on our waterways.
Safety remains our highest priority. Those who choose to use the water have a responsibility not only for their own wellbeing, but also for the safety of passengers and other water users.
We hope this case serves as a clear reminder and deterrent to others that reckless or unsafe behaviour on the water will not be tolerated and that appropriate enforcement action will be taken where necessary.”
The Commissioners would like to thank their customers and members of the public who also reported the unsafe behaviour and provided evidence that was used in the case.
During sentencing, the Judge made clear that a lack of knowledge or understanding of applicable rules was not an acceptable defence.
“Being naïve to the rules is not an excuse. If you own a boat, understanding your responsibilities comes with that ownership.”
Cattewater Harbour Commissioners continue to work closely with KHM, Devon & Cornwall Police, local authorities and partner agencies to ensure that Plymouth’s waters remain safe for all users, whether recreational, commercial or professional.
